1.2 Margin Driver operates a cloud-based, e-commerce management solution (the “Service”) available via our website (our “Website”)located at https://dashboard.margindriver.com and a mobile application.

2.1 Information you give to us. We collect personal information about you when you voluntarily submit information directly to us by filling in forms on our Website or by corresponding with us by phone, email or otherwise. This includes information you provide when you register to use our Website, subscribe to the Service, and when you report a problem with our Website, or use some other feature of the Service as available from time to time.  We collect your contact information and basic personal details, such as your full name, title, company name, billing address, email address, phone number, business website address, username, and password.  In addition, we collect details, such as your credit card information with authorization to charge for recurring monthly charges.  If you choose not to provide personal information, we may not be able to provide the Service to you or respond to your other requests.

We may receive personal information about you from individuals or corporate entities which are subscribers to the Service(“Subscribers”) where you are to be designated a user of the Service. We may receive personal information about you if you use any of the other websites we operate or the other services we provide from time to time. We also work closely with third parties (e.g., subcontractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies) and may receive information about you from them, subject to your agreements with them.  In addition, we may receive personal information about you through the API access granted by you to Margin Driver from your source systems (e.g., order management software, shipping software, Amazon AWS accounts, and accounting software).

2.3 Information collected automatically.  We, as well as third parties that provide content, analytics, advertising, or other functionality on our Services, may use cookies, pixel tags, local storage, and other technologies (“cookies”) to automatically collect personal information about you as to how you access and use the Service and information about the device you use to access the Service, which are stored in log files.  Cookies are used in analyzing trends, administering the site, tracking users’ movements around the site and to gather demographic information about our user base as a whole.  We may receive reports based on the use of these cookies by these companies on an individual as well as aggregated basis.  We may use the following types of cookies:

3.2 To Personalize User Experience.  We may link or combine the personal information we collect and/or receive about you and the information we collect automatically. This allows us to provide you with a personalized experience regardless of how you interact with us.

3.3 To Monitor and Improve the Service.  We use the information we collect to monitor and improve the Service, our Website and for internal operations.  We also use the information to address your questions, issues and concerns and resolve your customer service issues.  We may anonymize and aggregate any of the personal information we collect (so that it does not identify you). 3.4 For Administrative Purposes.  We may use collected information about you for administrative purposes, including to measure interest in our Service, develop new products and services, ensure internal quality control, verify individual identity, verify account information, account management, customer service, system maintenance, process payment for Services, prevent potentially prohibited or illegal activities, and enforce the User License Agreement between Margin Driver and the individual or business entity subscribing to Margin Driver’s Service (“User License Agreement”).We may also use the information to facilitate payment for use of the Service through a third-party intermediary to manage credit card processing, and to detect and prevent fraud.

3.5 For Marketing Purposes.   We use the information we collect to communicate with you, including sending statements, news, alerts, and marketing communications.  We may use personal information to provide you with materials about offers, products, and Services that may be of interest to you, including new content or services.  You may contact us at any time to opt-out of the use of your personal information for marketing purposes, as further described below.

4. SHARING THE INFORMATION WE COLLECT

4.1 With Our Team.  We may share your personal information with any member of our team in connection with the Service.  We may share anonymized or aggregated information internally for our own purposes.

4.2 With Selected Third Parties.  We will not sell or share your personal information with any third parties, except as described in this privacy policy or in connection with the Service. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction; (iv) to enforce Margin Driver policies or contracts; (v) to collect amounts owed to Margin Driver; (vi) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation or prosecution of suspected or actual illegal activity; or (vii) if we, in good faith, believe that disclosure is otherwise necessary or advisable.    

4.4 For Testimonials. With consent, we may display personal testimonials of satisfied customers on our site, along with other endorsements. If you wish to update or delete your testimonial, you can contact us at privacy@margindriver.com.

5. STORING THE INFORMATION WE COLLECT

All information you provide to us is stored on secure servers in a controlled environment with limited access. Any payment transactions will be encrypted in transit using SSL technology. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our Service, you are responsible for keeping this password confidential. Subscribers should not share their password with anyone.  While no transmission of information via the internet is completely secure, we take reasonable measures to protect your personal information. We cannot guarantee the security of your personal information transmitted to our Website; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.

The processing of information we collect is necessary for our legitimate interests, including to: (i) perform our obligations under the User License Agreement,(ii) communicate with you effectively for the purposes of resolving customer service issues, (iii) administer and improve the Service and our business; (iv) develop new services, (v) tailor the Service to the user and other marketing purposes, and (vi) conduct relevant analysis to improve the Service.

7. TRANSFERRING THE INFORMATION WE COLLECT

We may store all information we collect anywhere in the world, including but not limited to, in the United States, in the cloud, on our servers, on the servers of our affiliates or the servers of our service providers.

8. RETAINING THE INFORMATION WE COLLECT

8.1 We will only retain your personal information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of our legitimate business interests and satisfying any legal or reporting requirements.  We will retain your information for as long as your account is active, in accordance with the User License Agreement, or as needed to provide you Services.

8.2 To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and the applicable legal requirements.

9. YOUR RIGHTS WITH RESPECT TO YOUR PERSONAL INFORMATION

9.1 In accordance with applicable privacy law, you have the following rights in respect of your personal information that we hold:

Right of access and portability. The right to obtain access to your personal  information, and to receive that personal information in a commonly used format and to have it ported to another data controller.

Right to rectification. The right to obtain rectification of your personal information, or modify or update your account information, without undue     delay where that personal information is inaccurate or incomplete.    

Right to erasure. The right to obtain the erasure of your personal information without undue delay in certain circumstances, such as where the personal information is no longer necessary in relation to the  purposes for which it was collected or processed.    

Right to restriction.
The right to obtain the restriction of the processing undertaken by us on your personal information in certain circumstances,     such as where the accuracy of the personal information is contested by you, for a period enabling us to verify the accuracy of that personal     information.

Right to object. The right to object, on grounds relating to your particular situation, to the processing of your personal information, and to object to processing of your personal information for direct marketing purposes, to the extent it is related to such direct marketing.

Upon request, we will provide you with information about whether we hold any of your personal information. You may access, correct or request deletion of your personal information by logging into your account, or by contacting us at privacy@MarginDriver.com. We will respond to your request within 30 days.

10. LINKS TO THIRD PARTY SITES

10.1 The Service may, from time to time, contain links to and from third party websites. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for their policies. Please check the individual policies before you submit any information to those websites.

10.2 Some of the pages on our Website may utilize framing techniques to serve content to/from our partners while preserving the look and feel of our Website. Please be aware that you are providing your personal information to these third parties and not to Margin Driver.

11. OUR POLICY TOWARDS CHILDREN

The Service is not directed at persons under 16 and we do not intend to collect personal information from children under 16. If you become aware that a child has provided us with personal information without appropriate consent, then please contact us using the details below so that we can take the appropriate steps in accordance with our legal obligations and this privacy policy.

12. CHANGES TO THIS POLICY

We may update this privacy policy from time to time and so you should review this page periodically. When we change this privacy policy in a material way, we will update the “last modified” date at the end of this privacy policy. Changes to this privacy policy are effective when they are posted on this page.  Your continued use of the Website or Service constitutes your agreement to be bound by such changes to the privacy policy.  Your only remedy, if you do not accept the terms of this privacy policy, is to discontinue use of the Website and Service.
